Landlords who wish to repossess a dwelling as of July 1, 2022 have only a few weeks to send a Notice of Repossession. In fact, there is a 6-month deadline before the lease expires to notify tenants that the unit will be repossessed; therefore, the deadline for sending the Notice of Repossession is December 31, 2021 for leases ending on June 30, 2022.
The landlord must ensure that the notice that is sent is certified and admissible in court. In addition, receipt of the document must be dated and authenticated by the recipient. However, it is possible to send the notice by registered mail or even hand-deliver the notice with signature to the recipient.
Do not forget to justify the repossession request because some situations are not acceptable to validate its execution. For example, since 2016, it is not possible to repossess a dwelling occupied by a tenant with this profile: aged 70 years and over, who has lived in the dwelling for more than 10 years, and who receives a low income. However, the repossession of housing is valid when you want to move in yourself, an immediate family member, ex-spouse, parent, or ally.
